Last night my son and I went to a small, intimate restaurant that my late wife and I have gone to for 23+ years. We were celebrating his birthday. Never had a problem or a complaint EVER....until....
A "Euro-Trash" beatnik couple sat in the table 10 feet away from us. They had a small black poodle on the floor next to them on the floor. The dog barked loudly for the entire time I was there. Ruined my dinner. I finally complained to the owner of the restaurant to do something. He approached the couple and mentioned my complaint. The hippy woman, who spoke in an accent, turned and flipped me the bird, as did her euro-trash date. Words ensued.....I told her "to blow me"......then I listened/laughed as she had to translate/explain to her wimp date who had asked her what "blow me" meant in his language. The owner of the restaurant told me my dinner was free. My son and I left.
My question is......given the Lib-tard Emotional Support Dog Laws in California.....wrhat is the recourse to businesses or their customers when a dog/other Support animal is totally disruptive or dangerous to others. What could I have done? What could the restaurant owner done?
Excerpt below taken from a Law Firm website.....ambulance chasers looking for Support Animal discrimination.:
"The ADA law is very clear about service animals: in nearly all cases, the service animal is allowed to go where you are.
Moreover, a business is only allowed to ask you two questions when assessing your service animal:
"Is the dog a service animal required because of your disability?"
"What work or task has the dog been trained to perform?"
In almost all cases, any additional inquiry is not allowed under the ADA. However, many businesses demand to see "paperwork" documenting the qualifications of service animals, or worse yet, the extent and nature of your disability. This is highly illegal."
Any thoughts?
Service animals (dogs and miniature horses) are covered under the Americans with Disabilities Act. (Federal law) Service animals are not. Establishments can specify Service Animals only. That dog was not a service animal. Service animals are EXTREMELY well behaved. The lines are starting to blur a little bit between SA and ESA. Dogs that are in service to people with anxiety, PTSD, and other psychiatric disorders may not have a task they are trained for but are recognized as SA. Also, in local jurisdictions like here in AZ ESA are getting protection like SA do. If you have a no pets policy as a landlord you cannot deny someone that has an ESA on that basis.
If men can say they are a woman and thereby gain access to womens and girls locker rooms and are allowed to walk around stark naked in front of even little girls, I think you know the answer to your question. You have no recourse. How long ago did you lose your wife. I lost mine 3 years ago after 43 years of marriage and I’m still not over it.
Glad you gave it right back to the trashy wench.
Sounds like laguna beach.
kept waiting for the punch line. Sorry
personally I hate all dogs. They’re filth. They transmit fleas, bacteria, parasites. They bark, pee, crap wherever, that you have to clean up . They get hair all over .
I went to the liquor store the other day and their was a dog inside jumping on people. I told the clerk the dog was out of control. The clerk said, it’s my dog. She said , don’t you like dogs? I said No, I hate the things.
I consider people who own dogs Zoo Keepers. Dogs are worthless, serve no purpose unless you are on an actual farm and they herd other farm animals , protect your herds. And then you don’t let them inside your house .
The law firm website excerpt you quote is on the money.
Based on my experience, which includes several continuing legal education courses on the subject of service animals, service animals (at least in California) occupy a protected class one rung above illegal aliens and the homeless. Anything they do is golden. If you complain or try to stop anything they do, you're the villain.
