He's not innocent here. He's just as cynical as the rest of them.
Read the NYT stuff on their coverup scheme, Paterno personally intimidated and pretty much forced the independent oversight lady, I forget what office, to resign, in disgust. He was well aware of how Penn State did its dirty work and certainly participatory.
He was not charged in the child rape thing but especially because he was the Godhead of that university has moral ownership of this just as much as anyone else especially considering the entire athletic edifice was his particular domain. That means Sandusky. That means the facility where Sandusky allegedly did his evil work. That means his assistant coach who testified to a grand just he told Paterno explicit details of what happened.
Paterno was more than wise enough to know that had to go to the police and it didn't. He knew it could get tied up bureaucratically and perhaps disappear if he went within Penn State's own system. He chose the latter. He has ownership of this giant steaming pile of shit.
