yes, they did find him to have lied that is why they came down oh him and USC so hard. It is a bit late to now say we just thought your account was just 'inconsistent with other findings' that is a conclusion, and it is McNair's position that the conclusion was reached through manufactrured evidence or no evidence at all. This means that the NCAA had reckless disregard for the truth or falsity of their findings. See, they have to support their findings not only with substantia; evidence, but with credible evidence obtained through a fair process.

You make a good point about damages, but your point only goes to special damages. McNair will be entitled to general damages maybe even punitive damages for the NCAA's conduct in this case.

I am sure McNair is looking for work, he has a duty to mitigate damages if he is not so traumatized by the sanctions that he cannot.

Why didnt USC retain him? You mean USC should defy the NCAA when it is begging for a reduction in sanctions? No, USC had to please the NCAA by letting McNair go, Garrett go, Bush go, are you starting to get the drift? Until he gets his reputation back through the courts no College will touch McNair.
